Context

Yes Consumer Solutions Limited (YCSL) has been fined £170,000 by the ICO for making illegal marketing calls to consumers registered with the Telephone Preference Service (TPS).

Key points to note

  • YCSL made 188,493 illegal direct marketing calls over a 12 month period between October 2018 and October 2019.
  • Ironically YCSL sell nuisance call blocking systems which meant they had the technology to check their marketing lists against the TPS but decided against doing so.
  • In all 13 complaints were received about the company which prompted the ICO investigation.
  • Contacting people who have been registered with the TPS for longer than 28 days is against electronic marketing law (Privacy and Electronic Communications Regulations (PECR).

Next actions

We suggest your firm should review its application of marketing preferences and confirm its compliance with electronic marketing law as set out in the Privacy and Electronic Communications Regulations (PECR).
