Context
The FCA has published a Final Notice prohibiting David Nicholas King from performing any function in relation to any regulated activity carried on by any authorised person, exempt person or exempt professional firm.
Key points to note
- Whilst an employee and an approved person at authorised firms, Mr King engaged in criminal activity. Mr King pleaded guilty to and was convicted on 3rd October 2019 of three counts of theft, one count of fraud by false representation and one count of acquiring/using/possessing criminal property.
- The Authority has concluded, based on the facts and matters set out below, that Mr King is not a fit and proper person to perform any function in relation to any regulated activity carried on by an authorised person, exempt person or exempt professional firm.
- The convictions all related to matters arising outside of Mr King’s work and employ and were, in essence, private family matters.
