FSCS is now open to claims – Arthur Temlett t/a Abacus Insurance Consultants

Context

FSCS has confirmed that it is now open to claims in relation to Arthur Temlett, trading as Abacus Insurance Consultants, deeming the firm to be ‘under investigation’, but FSCS has not yet established whether or not it will be able to pay compensation.  Arthur Temlett is a sole trader who was first authorised on 29th April 1988 and has been operating in the Dumfries area.  On 21st January 2025, the FCA placed restrictions on Arthur Temlett in response to allegations that insurance premiums were not being passed on to insurers.

Key points to note and next actions

  • If customers believe they have an FSCS protected claim against Arthur Temlett, they can now submit that to FSCS, using its online claim service.
  • For FSCS to take this step, it is perhaps likely that insurers are not honouring the insurance contracts (unless there was risk transfer in place, they don’t have to); it is still maybe too early to know exactly what the circumstances of this case are / were.
  • FSCS is aware that Police Scotland are in contact with Arthur Temlett’s customers.  FSCS will be providing Police Scotland with information to enable them to inform members of the public about FSCS and its claims process. Customers can also contact FSCS directly on 0800 678 1100.
  • FSCA is currently working with the FCA and Police Scotland to gather relevant information.
  • FSCS will be investigating Arthur Temlett to determine whether claims meet the qualifying conditions for FSCS to pay compensation, and this may take some time. This means it has not yet established whether or not it will be able to pay compensation.
